A federal judge in California has temporarily dismissed a trade-secrets lawsuit filed by Elon Musk’s artificial intelligence startup xAI against rival OpenAI, citing insufficient allegations of wrongdoing. U.S. District Judge Rita Lin ruled that xAI failed to show OpenAI induced former xAI employees to steal confidential information or that stolen trade secrets were used at OpenAI.

The lawsuit, originally filed in September, claimed that ex-xAI employees took source code from xAI’s Grok chatbot when moving to OpenAI. Judge Lin noted the complaint lacks direct allegations against OpenAI itself and has given xAI until March 17 to amend and potentially refile its case.

This legal action is part of a broader dispute between Musk, OpenAI, and Microsoft. Musk is also pursuing a separate case over OpenAI’s transition to a for-profit company, seeking damages up to $134.5 billion, with jury selection scheduled for April 27. OpenAI has described the trade-secrets suit as a baseless attempt to harass a competitor, highlighting Grok’s inability to keep pace with ChatGPT.

While the ruling is a short-term victory for OpenAI, xAI retains the option to file an amended complaint, meaning the legal battle—and the high-stakes competition in AI—may continue. The case underscores the intense rivalry in the AI industry, where protecting intellectual property and technological leadership remains a top priority.

OpenAI avoids immediate liability, but ongoing disputes with Musk’s xAI highlight the legal and commercial battles shaping the future of artificial intelligence.
