A pivotal ruling in the United States is forcing a rethink of how safe it is to confide in artificial intelligence: can your AI chats be used against you in court?
The question has taken on new urgency following a decision by Jed Rakoff in New York, who ruled that conversations generated through AI tools are not protected by attorney-client privilege. The case involved Bradley Heppner, a former financial executive accused of fraud, who had used the chatbot Claude to help prepare materials related to his legal defense.
Rakoff ordered that dozens of AI-generated documents be handed over to prosecutors, emphasizing that no legal relationship exists between a user and an AI system. The judgment marks one of the earliest and most consequential tests of how traditional legal protections apply in the era of generative AI.
The implications extend far beyond a single case. Legal experts across the North America are warning clients that interactions with AI platforms such as ChatGPT may be discoverable in both criminal prosecutions and civil lawsuits. Unlike communications with licensed attorneys, which are generally confidential, chatbot exchanges could be treated as ordinary digital records.
This distinction is critical. Attorney-client privilege—a cornerstone of legal systems in countries like the United States—can be waived if sensitive information is shared with third parties. Increasingly, courts appear willing to treat AI platforms as such third parties, especially when their terms of service allow for data retention or sharing by companies like OpenAI and Anthropic.
Yet the legal landscape remains unsettled. In a separate ruling from Michigan, Anthony Patti reached a different conclusion, determining that a litigant’s ChatGPT interactions could qualify as protected “work product.” In his view, AI functions more like a tool than a person—an interpretation that could preserve some degree of legal protection under specific circumstances.
The conflicting decisions illustrate a broader tension: the law is struggling to keep pace with rapidly evolving technology. Courts must now decide whether AI should be treated as a passive instrument, like a notebook, or as an external entity capable of undermining confidentiality.
For individuals and businesses, the takeaway is immediate and practical. AI chatbots are powerful tools, but they are not private advisors. Sharing legal strategies, confidential data, or sensitive personal information with them could carry unintended consequences—potentially turning a helpful query into courtroom evidence.
